Trump Grants TikTok 75-Day Extension to Address U.S. Security Concerns

On January 20, 2025, President Donald Trump signed an executive order granting TikTok a 75-day extension to address national security concerns, postponing a potential ban of the popular video-sharing app in the United States. This decision follows the enactment of the Protecting Americans from Foreign Adversary Controlled Applications Act (PAFACA), which required ByteDance, TikTok’s Chinese parent company, to divest its U.S. operations by January 19, 2025.

The Supreme Court upheld this law, emphasizing the need to protect user data from potential foreign influence. In response to the looming deadline, TikTok temporarily suspended its services in the U.S. on January 18, 2025, affecting its 170 million American users. However, after President Trump’s assurance of an extension, the platform resumed operations, providing relief to its extensive user base.

The executive order not only delays the ban but also directs the U.S. Attorney General to refrain from enforcing PAFACA during this period. Additionally, it instructs the Department of Justice to inform companies like Apple, Google, and Oracle that they will not face legal consequences for hosting or updating TikTok during the extension.

This 75-day reprieve offers ByteDance the opportunity to negotiate a resolution, which may include selling TikTok’s U.S. operations or forming a joint venture with an American company. President Trump has suggested a potential 50% ownership stake by a U.S. entity to alleviate security concerns, though this proposal raises questions about content moderation and First Amendment rights.
